如果你想在峇里舉行具有法律效力的婚禮,請先閱讀以下資料,因為真係非常之麻煩。作為一個律師,我都覺得這些文件實在是太麻煩了。所以,除非你聘用了一個wedding planner,仲要係一個非常organised及有經驗的wedding planner,不然請三思。 先說說我們的經驗,從去年中開始我們已經與Bali的酒店直接聯絡,安排結婚的東西,中間並沒有任何香港的agent或wedding planner。一開始酒店説香港人可以在峇里做legal wedding,但就需要安排當地的agent,費用為美金750元。酒店話,根據當地的規矩,每間酒店都只可以與一間agent合作,不可以與其他agent合作,所以不可以選擇那個agent。好了,以為750美金就是所有費用嗎,你錯了。 到今年1月頭,我們再三追問酒店到底legal wedding要準備什麼,酒店都沒怎樣回覆。突然一天,酒店那邊説,香港人不能在峇里註冊結婚,說是香港這邊有法律變更,規定香港人不能在峇里結婚。真的好笑,第一,我沒有聽說有任何法律的改變,第二,如果是海外結婚有法規改變了,應該是一件很大的事情,應該新聞上一定會看得到,第三,畢竟我不是這方面的律師,請去問了朋友,也沒有人聽說有這樣的法規改變。 這樣纏繞了一兩週,突然酒店/當地agent又說,香港人可以在峇里註冊結婚,但是我們必須去把證書拿去jakarta那邊的領事館。不會吧,要專程去jakarta?從來沒聽過。因為據我們所知,只要回香港後通知入境處我們的marital status有變更就可以了,為什麼要去jakarta?? 好,再過了一週,那邊的agent就說,我們不用去jarkata,但是就需要提供一大堆的文件。文件如下: 首先兩位需要去香港的婚姻註冊處申請“沒有結婚紀錄證書”,可以在網上申請。調查費用為港幣$140,證書費用為港幣$680。網上申請之後,大概9個工作天後,你本人需要去婚姻註冊處繳費及拿取該證書。(網址:https://www.immd.gov.hk/eng/services/marriage/Certificate_of_Absence_of_Marriage_records.html) 之後你須要找一個公證人(notary public)(不是每個律師都是公證人),讓他出具一張公證書,證明你倆是單身。一張公證書費用為港幣$2200-3500不等。你需要提供身分證、護照副本,及提供“沒有結婚紀錄證書”正本予公證人。如果文件齊的話,一週內就可以拿到公證書。 拿到公證書後,你須要拿去高等法院LG115加簽(apostille),費用為港幣$125,2-3個工作天能取回。(網址:http://www.judiciary.hk/en/crt_services/apostille.htm) 加簽之後,還未完。之後你需要去香港的印尼領事館。這個是我們的agent沒有告訴我們的,他只說我們要去領事館拿個蓋章,不知道是什麼蓋章,去了領事館之後,原來是要把這個公證書變成有法律效用(legalize the notary certificate)。我來回了3次領事館,就為了這個蓋章。anyway, 去領事館之前,請準備1.一封cover letter,說明需要在印尼使用這份共證書的原因(就簡單說是為了要在bali結婚就可以),2.公證書正本及副本一份(要有高院加簽),3.兩人的身分證及護照副本,4.兩人的沒有結婚紀錄證書的副本。帶齊所有文件後,請到領事館4樓的3號counter,那個員工會給你一張付費單。但先不需要繳費,他們會打電話給你,告訴你文件已經好了,你才去繳費。大概需要3個工作天。若果你對需要的文件有疑問,在準備任何東西之前,你可以先去領事館查詢,他們會給你一個文件清單,及一些文件樣本。 收到電話確認後,你須要到印尼領事館附近的印尼銀行繳交港幣$968元,只收現金。然後銀行職員會把一張藍色的收費確認還給你。你就把這張紙交給3號counter,然後等他把文件給你,那你就完成了。 這是在香港需要做的事情。然後,你需要向你的bali agent提供以下文件,他們才可以遞交予bali 的civil registry: 兩人的護照副本 兩人的出世紙副本 兩人的沒有結婚紀錄證書的副本 公證書(加簽及有印尼領事館蓋章)副本 要填寫一份civil form,提供兩人及父母及見證人資料(見證人不能是父母) 一張4x6cm照片,新郎在左面,新娘在右面,背景為藍色或紅色,可以去到bali先拍照 記得,這些文件的正本是必須要帶過去bali的。 費用到現在是多少?bali agent的美金750元,沒有結婚紀錄證書的港幣$140+$680,公證書港幣$2500,加簽港幣$125,領事館港幣$968,total港幣$10263。仲要未計翻譯費用,當地agent説向當地civil registry提交的文件需要翻譯成印尼文,每張紙要美金$35。但由於他們把所有的事情都搞砸了,就是3-4個禮拜從香港人不能在那邊結婚,到可以結婚但要去jakarta,到最後不用去jakarta,那些翻譯費用由他們去承擔。不然的話,那是有9張紙需要翻譯。 對比係香港註冊結婚,費用為港幣$305,我做證婚都是收$2500-3000,你看那個差別有多大。還要做那麼多的文件,及走來走去。如果你是有wedding planner的話,那可能好一點。但是沒有結婚紀錄證書的副本及公證書這些,你還是要自己親身去弄。 既然都洗濕左個頭,也沒辦法。4月底在bali結婚,回來再update一下。這算是一個很好很特別的經驗吧。沒想到會那麼麻煩。網上的資料也太少了。希望對你安排bali婚禮時有用。 [update] – 記得返香港之後要向入境處file張form ROP18 (https://www.immd.gov.hk/pdforms/rop18.pdf),無其他登記手續要做架啦! Brief procedure for getting legally married in Bali for Hong Kong residents: need to apply for Certificate of Absence of Marriage Record from the Marriage Registry in Hong Kong. Search fee is HK$140, the certificate itself is HK$680. You can apply online. It takes around 9 working days, you will need to go to the Marriage Registry in person to collect the certificate and to pay the HK$680 fee. (Website: https://www.immd.gov.hk/eng/services/marriage/Certificate_of_Absence_of_Marriage_records.html) then you need to find a notary public in HK to issue a notary certificate, certifying that you two are single. you need to submit the Certificate of Absence of Marriage Record to the notary public together with you two's IDs and passport copies. The cost for a notary certificate can range from HK$2200 to HK$3500, depending on who you find. If all documents are ready, you should be able to get the notary certificate within 1 week. after that, you need to take the notary certificate to the High Court for apostille. LG115 of High Court, it costs HK$125 and takes around 3 working days. (Website: http://www.judiciary.hk/en/crt_services/apostille.htm) after getting the apostille on the notary certificate, you need to get to go to the indonesian consulate in Hong Kong to get the notary certificate legalized. you need to bring a cover letter explaining the purpose of the notary certificate, the original notary certificate and an extra copy, copies of you two's IDs and passports, and copy of the Certificate of Absence of Marriage Record of both of you. after submitting these documents to the consulate (3rd counter on 4/F), they will give you a payment note. but you only have to pay the fee of HK$968 after they call you saying you can pick up the certificate. it takes around 3 working days. after the consulate calls you, you need to go to the indonesian bank near the consulate to settle the fee. the bank will give you a blue payment receipt, bring that back to 3rd counter on 4/F of the consulate, then they will give you back the notary certificate with the consulate chop. this is not the end, then you need to provide the following documents to the local agent in Bali for submission to the Bali civil registry: passport copies of bride and groom birth certificate copies of bride and groom Certificate of Absence of Marriage Record copies of bride and groom copy of the notary certificate (with apostille and consulate chop) fill out a civil form, providing details of the bride and groom, their parents and witnesses (witnesses must not be parents) 4x6cm photo, with groom on the left, bride on the right, with blue or red background, you can take this in bali these documents will need to be translated into indonesian. each page costs US$35. and you will need to bring all the originals to Bali for your wedding. It would be better if you have an agent or wedding planner in Hong Kong to help you out, but then for the Certificate of Absence of Marriage Record and the notary certificate, you will still need to do it yourself. A very tedious procedure. If you are not sure about the documents required, you can go to the consulate to ask, they will give you a document checklist and some templates of the required documents.
